Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen en overeenkomsten die worden gesloten met Denim Depot Nederland, handelend onder de naam Denim Depot Nederland. Door gebruik te maken van onze website of door een bestelling te plaatsen, gaat u akkoord met deze voorwaarden.

Algemeen gedeelte / General Provisions

Artikel 1 – Definities / Definitions

Nederlands:

  1. "Ondernemer": Denim Depot Nederland
  2. "Klant": iedere natuurlijke persoon of rechtspersoon die een overeenkomst aangaat met de ondernemer.
  3. "Consument (B2C)": een klant die een natuurlijk persoon is en handelt buiten zijn beroep of bedrijf.
  4. "Zakelijke klant (B2B)": iedere klant die handelt in de uitoefening van beroep of bedrijf.
  5. "Overeenkomst": iedere overeenkomst tussen ondernemer en klant met betrekking tot producten of diensten.
  6. "Producten": vintage en tweedehands kleding aangeboden via de webshop of anderszins.

  5. "Agreement": any contract between entrepreneur and customer concerning products or services.
  6. "Products": vintage and second-hand clothing offered through the webshop or otherwise.

2. Voorwaarden voor Consumenten (B2C) / Terms for Consumers (B2C)

Artikel 2 – Toepasselijkheid / Applicability

Nederlands:
Deze voorwaarden zijn van toepassing op elk aanbod van de ondernemer aan consumenten en op elke tot stand gekomen overeenkomst op afstand.

These terms apply to every offer made to consumers and every distance contract concluded.

Artikel 3 – Het aanbod / The Offer

Nederlands:

  1. Indien een aanbod een beperkte geldigheidsduur heeft, wordt dit duidelijk vermeld.
  2. Afbeeldingen van producten zijn representatief; kleur- of detailafwijkingen kunnen voorkomen omdat het om vintage/tweedehands gaat.

English:

  1. If an offer has a limited validity, this will be clearly stated.
  2. Product images are representative; minor variations may occur as items are vintage/second-hand.

Artikel 4 – Herroepingsrecht (Consumenten) / Right of Withdrawal (Consumers)

Nederlands:

  1. Termijn en reikwijdte. De consument heeft het recht de overeenkomst binnen 14 dagen na fysieke ontvangst van de goederen zonder opgave van redenen te herroepen. Bij deelleveringen begint de termijn te lopen op de dag waarop de consument het laatste artikel ontvangt.
  2. Hoe herroepen. Herroeping kan door een duidelijke verklaring per e-mail of de whatsapp klantenservice aan Info@denimdepotnederland te schrijven of door gebruik te maken van het Model­formulier voor herroeping (zie onderaan). Voorafgaande goedkeuring is niet vereist.
  3. Retourtermijn. Na herroeping heeft de consument nog 14 dagen om de producten terug te zenden.
  4. Kosten retourzending. De rechtstreekse kosten van het terugzenden komen voor rekening van de consument, er zijn gevallen waarbij we dit voorschieten en van het retour te betalen bedrag aftrekken.
  5. Terugbetaling. Bij herroeping worden alle van de consument ontvangen betalingen onverwijld en uiterlijk binnen 14 dagen na melding van herroeping terugbetaald, exclusief de uitgevoerde zendingskosten (eventuele extra kosten voor niet-standaard, duurdere bezorgopties worden niet vergoed). Wij mogen wachten met terugbetalen totdat wij de goederen hebben ontvangen of totdat de consument aantoont dat de goederen zijn teruggezonden, naar gelang welk tijdstip eerst valt. Terugbetaling gebeurt via hetzelfde betaalmiddel waarmee de oorspronkelijke transactie is verricht, tenzij uitdrukkelijk anders overeengekomen en zonder kosten voor de consument.
  6. Omgang met de producten & waardevermindering. De consument mag de producten hanteren voor zover nodig om de aard, kenmerken en werking vast te stellen, zoals dat in een fysieke winkel zou mogen. Om in aanmerking te komen voor een terugbetaling, moet uw artikel/bestelling in dezelfde staat verkeren als ontvangen.
    • Voorbeelden die kunnen leiden tot retourweigering: dragen buitenshuis, wassen, strijken, verwijderen van labels/hangtags, het aanbrengen van geuren/vlekken, wijzigingen/aanpassingen.
    • Toelichting voor vintage/tweedehands: lichte gebruikssporen eigen aan vintage zijn normaal; extra gebruik door de consument kan tot een redelijke aftrek op de terugbetaling leiden.
    • Inspecteer uw bestelling bij ontvangst en neem onmiddellijk contact met ons op in geval van defecte, beschadigde of onjuiste artikelen. Als gevolg van menselijke fouten kunnen zakken/bundels/balen/dozen tot 20% Grade B-artikelen bevatten.
  7. Gedeeltelijke of bundelbestellingen. Wanneer artikelen als één bundel/set voor één totaalprijs zijn verkocht, kan herroeping worden gevraagd voor de volledige bundel. Bij afzonderlijk geprijsde artikelen is gedeeltelijke herroeping per artikel toegestaan.
  8. Uitzonderingen. Het herroepingsrecht geldt niet voor:
    • goederen die naar specificaties van de consument zijn vervaardigd of duidelijk op de persoon zijn afgestemd, zoals personalisatie van het pakket.
  9. Kwaliteitsverwachting vintage/tweedehands. Vanwege het karakter van vintage/tweedehands artikelen kunnen milde gebruikssporen aanwezig zijn; dit is geen gebrek. Indien een wezenlijk gebrek aanwezig is dat niet uit de beschrijving/afbeeldingen viel af te leiden, verzoeken wij om onverwijld contact op te nemen via info@denimdepotnederland.com
  10. Retouradres en instructies. Stuur bij retourzending het ordernummer mee en volg de instructies die wij na je melding toesturen. Retourzendingen naar een ander adres of zonder identificerende gegevens uit eigen initiatief kunnen vertraging opleveren bij verwerking of niet worden geaccepteerd.

  1. Period and scope. Consumers may withdraw from the contract within 14 days from physical receipt of the goods without giving any reason. For multiple deliveries, the period starts on the day the consumer receives the last item.
  2. How to withdraw. Withdrawal can be made by sending a clear statement by email to info@denimdepotnederland.com or via our WhatsApp customer service, or by using the Model Withdrawal Form (see below). Prior approval is not required.Return deadline. After withdrawal, the consumer has another 14 days to return the products.
  3. Return period. After withdrawal, the consumer has 14 days to return the products.
  4. Return costs. The direct costs of returning the goods are borne by the consumer; in some cases we may advance these costs and deduct them from the refund.
  5. Refund. In the event of withdrawal, all payments received from the consumer will be refunded without delay and no later than 14 days after notification of withdrawal, excluding the executed shipping costs (any additional costs for non-standard, more expensive delivery options will not be reimbursed). We may withhold the refund until we have received the goods or until the consumer provides proof that the goods have been returned, whichever occurs first. Refunds will be made using the same means of payment used for the original transaction, unless expressly agreed otherwise and without fees for the consumer.
  6. Handling & diminished value. The consumer may handle the goods only to the extent necessary to establish the nature, characteristics and functioning, as would be allowed in a physical shop. The consumer is liable for any diminished value resulting from handling beyond what is necessary.
    • Examples likely to cause diminished value: wearing outdoors, washing, ironing, removing labels/hangtags, adding odors/stains, alterations.
    • Note for vintage/second-hand: minor wear inherent to vintage is normal; additional use by the consumer may result in a reasonable deduction from the refund.
    • To be eligible for a refund, your item/order must be in the same condition as received, subject to normal handling necessary to establish the nature, characteristics and functioning.
      Please inspect your order upon receipt and contact us immediately in case of defective, damaged or incorrect items. Due to human error, bags/bundles/bales/boxes may contain up to 20% Grade B items.
  7. Partial returns and bundles. Where items are sold as one bundle/set for a single price, withdrawal may be exercised for the entire bundle. Where items are individually priced, partial withdrawal per item is permitted.
  8. Exceptions. The right of withdrawal does not apply to:
    • goods made to the consumer’s specifications or clearly personalized;
    • sealed goods not suitable for return due to health protection or hygiene and whose seal has been broken after delivery (only applicable where relevant and clearly indicated for the product).
      (Other statutory exceptions apply only where relevant and clearly communicated to the consumer in advance.)
  9. Vintage quality expectation. Due to the nature of vintage/second-hand goods, minor signs of wear may be present; this does not constitute a defect. If a material defect exists that could not be inferred from the description/images, please contact us immediately.
  10. Return address & instructions. Include the order number with your return and follow the instructions we send after your notice. Returns to a different address or without identifying details may delay processing or may not be accepted.

NL: 

Gratis artikelen die onderdeel zijn van een actie (zoals Black Friday bonussen, gratis extra voorraad of gratis mysterie-items) maken onderdeel uit van de totale bestelling.
Bij het retourneren van de bestelling dienen deze gratis artikelen altijd mee retour te worden gestuurd.
Indien de gratis artikelen niet worden geretourneerd, is Denim Depot Nederland gerechtigd de retour te weigeren of het restitutiebedrag te verminderen met de waarde van de ontbrekende artikelen.
Gratis producten zijn alleen gratis bij behoud van de oorspronkelijke bestelling.

EN: 

Free items that are part of a promotion (such as Black Friday bonuses, free extra stock, or free mystery items) are considered part of the total order.
When returning an order, these free items must always be included in the return shipment.
If the free items are not returned, Denim Depot Nederland reserves the right to refuse the return or reduce the refund by the value of the missing items.
Free products are only free when the original order is kept.

Artikel 5 – Garantie en conformiteit / Warranty and Conformity

Nederlands:

  1. De consument heeft recht op wettelijke garantie: het product moet voldoen aan de redelijke verwachtingen.
  2. Omdat het om vintage/tweedehands gaat, wordt normale gebruiksslijtage geaccepteerd.

English:

  1. Consumers are entitled to statutory warranty: products must meet reasonable expectations.
  2. As items are vintage/second-hand, normal signs of wear are acceptable.

Artikel 6 – Levering en risico / Delivery and Risk

Nederlands:

  1. De ondernemer draagt het risico van verzending totdat de consument de bestelling fysiek heeft ontvangen.
  2. Levering vindt plaats op het door de consument opgegeven adres.

3.       Wij behouden ons het recht voor om verzendpartners te kiezen en verzendkosten in rekening te brengen. Bij het retourneren van Bundels/Dozen brengen wij de gemaakte zendingskosten per verzonden doos in rekening voor de klant.

      Het kan tot 4 werkdagen duren (exclusief weekenden en feestdagen) voordat alle bestellingen zijn verwerkt. Na verwerking ontvangt u een trackingnummer per e-mail zodra de pakketten zijn overhandigd aan onze verzendpartners.

  2. Delivery takes place at the address provided by the consumer.

Artikel 7 – Klachtenprocedure / Complaints Procedure

Nederlands:

  1. Klachten moeten zo spoedig mogelijk, volledig en duidelijk omschreven worden ingediend via e-mail of onze whatsapp klantenservice.
  2. Binnen 14 dagen na ontvangst wordt inhoudelijk gereageerd.
  3. Indien een klacht niet in overleg kan worden opgelost, kan de consument zich wenden tot de geschillencommissie of bevoegde rechter.

  1. Complaints must be submitted by email or the whatsapp customer service as soon as possible, fully and clearly described.
  2. A substantive response will be given within 14 days of receipt.
  3. If a complaint cannot be resolved amicably, the consumer may contact the dispute resolution body or competent court.

Artikel 8 – Privacy / GDPR

Nederlands:

  1. De ondernemer verwerkt persoonsgegevens volgens de geldende AVG/GDPR-regelgeving.
  2. Persoonsgegevens worden uitsluitend gebruikt voor uitvoering van de overeenkomst.

3.       Persoonlijke informatie valt onder ons privacybeleid.

English:

  1. The entrepreneur processes personal data in accordance with applicable GDPR legislation.
  2. Personal data are used solely for the performance of the agreement.
  3. Personal information is governed by our Privacy Policy.
3. Voorwaarden voor Zakelijke klanten (B2B) / Terms for Business Customers (B2B)

Artikel 9 – Toepasselijkheid / Applicability

Nederlands:
Deze voorwaarden zijn van toepassing op elke zakelijke overeenkomst met Denim Depot Nederland.

English:
These terms apply to every business agreement with Denim Depot Nederland.

Artikel 10 – Geen herroepingsrecht / No Right of Withdrawal

Nederlands:

  1. Voor zakelijke klanten geldt geen herroepingsrecht.
  2. Retouren zijn alleen mogelijk na schriftelijke goedkeuring van de ondernemer.

English:

  1. Business customers have no right of withdrawal.
  2. Returns are only possible with prior written approval of the entrepreneur.

Artikel 11 – Levering en risico / Delivery and Risk

Nederlands:

  1. Het risico van verlies of beschadiging gaat over op de zakelijke klant zodra de vervoerder het pakket in ontvangst neemt.
  2. Levertermijnen zijn indicatief en nooit fataal.

English:

  1. The risk of loss or damage passes to the business customer once the carrier takes possession of the package.
  2. Delivery times are indicative and never binding.

Artikel 12 – Garantie en aansprakelijkheid / Warranty and Liability

Nederlands:

  1. Voor zakelijke klanten geldt beperkte garantie: enkel indien een product wezenlijk niet overeenkomt met de overeenkomst.
  2. Aansprakelijkheid van de ondernemer is beperkt tot het factuurbedrag van de betreffende bestelling.
  3. De ondernemer is niet aansprakelijk voor gevolgschade, indirecte schade of gederfde winst.

English:

  1. Business customers have limited warranty: only if a product substantially does not conform to the agreement.
  2. Liability of the entrepreneur is limited to the invoice amount of the order concerned.
  3. The entrepreneur is not liable for consequential damages, indirect damages, or loss of profit.

4. Slotbepalingen / Final Provisions

Artikel 13 – Toepasselijk recht / Governing Law

Nederlands:
Op alle overeenkomsten is uitsluitend Nederlands recht van toepassing.

English:
All agreements are governed exclusively by Dutch law.

Artikel 14 – Bevoegde rechter / Competent Court

Nederlands:
Geschillen worden uitsluitend voorgelegd aan de bevoegde rechter in Nederland.

English:
Disputes will be submitted exclusively to the competent court in the Netherlands.

Artikel 15 – Scheidbaarheid / Severability

Nederlands:
Indien een bepaling ongeldig blijkt, blijven de overige bepalingen volledig van kracht.

English:
If any provision is invalid, the remaining provisions remain fully in force.

Artikel 16 – Wijzigingen / Amendments

Nederlands:
De ondernemer behoudt zich het recht voor deze voorwaarden te wijzigen. De versie die geldt op het moment van de overeenkomst is van toepassing. Productprijzen kunnen zonder voorafgaande kennisgeving worden gewijzigd.

English:
The entrepreneur reserves the right to amend these terms. The version applicable at the time of the agreement shall apply. Product prices may be changed without prior notice.

 

5. Overige bepalingen / Additional Provisions

Artikel 17 – Leeftijdsbeperking / Age Restriction

Nederlands:
Door een bestelling te plaatsen, verklaart de klant minimaal 18 jaar oud te zijn of toestemming te hebben van een ouder of wettelijke voogd.

English:
By placing an order, the customer declares to be at least 18 years old or to have permission from a parent or legal guardian.

Artikel 18 – Verboden gebruik / Prohibited Use

Nederlands:
Onze producten en website mogen niet worden gebruikt voor illegale doeleinden, noch in strijd met toepasselijke wet- en regelgeving. Misbruik van onze diensten kan leiden tot weigering van toekomstige bestellingen.

English:
Our products and website may not be used for illegal purposes, nor in violation of applicable laws and regulations. Misuse of our services may result in refusal of future orders.

Artikel 19 – Weigering van bestellingen / Right to Refuse Orders

Nederlands:
De ondernemer behoudt zich het recht voor bestellingen te weigeren of te annuleren in geval van misbruik, fraude, betalingsproblemen of andere gegronde redenen.

English:
The entrepreneur reserves the right to refuse or cancel orders in cases of misuse, fraud, payment issues, or other legitimate reasons.

Artikel 20 – Intellectuele eigendom / Intellectual Property

Nederlands:
Alle teksten, foto’s, ontwerpen en andere inhoud op de website van Denim Depot Nederland zijn auteursrechtelijk beschermd. Het is niet toegestaan enig deel van de inhoud te kopiëren, reproduceren, verspreiden of exploiteren zonder voorafgaande schriftelijke toestemming van de ondernemer.

All texts, photos, designs, and other content on the DenimDepotNederland website are protected by copyright. It is not permitted to copy, reproduce, distribute, or exploit any part of the content without prior written consent of the entrepreneur.

Artikel 21 – Links van derden / Third-Party Links

Nederlands:
Onze website kan links bevatten naar websites van derden. Deze websites zijn niet onder onze controle en wij zijn niet verantwoordelijk voor de inhoud, juistheid of transacties die via deze websites plaatsvinden. Gebruik van dergelijke links is volledig voor eigen risico van de klant.

Our website may contain links to third-party websites. These websites are not under our control, and we are not responsible for the content, accuracy, or transactions carried out on such websites. Use of these links is entirely at the customer’s own risk.

Artikel 22 – Feedback en opmerkingen van klanten / Customer Feedback and Comments

Nederlands:
Klantreacties, reviews of andere opmerkingen die bij ons worden ingediend, mogen door de ondernemer worden gebruikt, bewerkt, gepubliceerd of gedeeld voor commerciële en communicatieve doeleinden. Ingezonden opmerkingen mogen geen rechten van derden schenden of onrechtmatig, lasterlijk of schadelijk materiaal bevatten.

Customer feedback, reviews, or other comments submitted to us may be used, edited, published, or shared by the entrepreneur for commercial and communication purposes. Submitted comments may not infringe third-party rights or contain unlawful, defamatory, or harmful material.

Artikel 23 – Optionele tools van derden / Optional Third-Party Tools

Nederlands:
Wij kunnen toegang bieden tot tools van derden die wij niet controleren of beheren. Deze tools worden geleverd “zoals ze zijn” en zonder enige garanties. Gebruik van dergelijke tools is volledig voor eigen risico van de klant.

We may provide access to third-party tools which we do not control or manage. These tools are provided “as is” and without any warranties. Use of such tools is entirely at the customer’s own risk.

Artikel 24 – Beveiliging betalingsgegevens / Payment Data Security

Nederlands:
Wij nemen redelijke maatregelen om de veiligheid van betalingsgegevens te beschermen. Creditcard- en betaalgegevens worden altijd gecodeerd verzonden tijdens overdracht via beveiligde netwerken.

We take reasonable measures to protect the security of payment data. Credit card and payment information is always encrypted during transmission over secure networks.
